Mesher Order granted for former matrimonial home

Melanie represented the Respondent in a case involving very modest assets, which was listed for a final contested hearing.

The main issues were whether (i) it was appropriate for the former matrimonial home to be subject to a Mesher Order and if so, the percentage to be awarded to each of the parties and (ii) how the respective parties were going to re-house and whether it was appropriate for either of them to rehouse by virtue of a shared ownership scheme.

A Mesher Order was granted in the terms sought by Melanie’s client. The Court ruled that it was appropriate in all the circumstances for consideration to be given to whether the parties could be re-housed by virtue of shared ownership.
