Edward Kenny

I am an experienced family and civil law practitioner specialising in children law, both public and private as well as complex financial remedies arising out of divorce, and matters involving TOLATA.

In financial remedy proceedings I act for clients in cases across the spectrum, from those limited to need or with modest wealth to multi-million pound cases involving complex asset structures. My clients’ cases often involve business assets, investment properties, sizeable pensions and trusts as well as issues of post-separation earning, conduct, and inherited wealth, but may simply revolve around the marital home.

I regularly act for clients who were not married to their ex-partners and are in dispute about their former home.

My considerable experience encompasses cases involving children, including, in private law proceedings, removal from the jurisdiction, domestic violence and intractable hostility and, in public law proceedings, non-accidental injuries, chronic neglect and physical and emotional abuse.

I can act for you if your case involves allegations of domestic violence, and I have frequently represented people either seeking or opposing applications for non-molestation and occupation orders.

My clients value my ability to deal tactfully with delicate emotional situations, and appreciate my efforts to explain complex legal issues to people unfamiliar with the legal process. I aim to give you pragmatic and sensible advice so that you can take a long-term view of your situation and find a solution which, where possible, avoids the stress and expense of a long-running dispute. In the courtroom I have a reputation for persuasive advocacy and steadfast support of my clients.

I also have a broad civil practice and regularly appear in fast-track and multi-track trials. This civil practice includes housing law and cash and asset forfeiture proceedings.

Private Law (Child Arrangements Programme)

I act regularly in private law proceedings concerning children, representing parents and family members in disputes over where their child should live and spend their time. You might be simply having difficulty reaching an agreement, or there may be other aspects involved, such as concerns over the other parent’s behaviour – for example I have acted in cases where one parent has anger management issues.

I can also act for you in disputes over matters of parental responsibility, including removal of your children within and out of the jurisdiction (to another part of, or out of the country), your child’s surname and his or her health and educational needs (known as specific issue and prohibited steps orders).

I frequently act in cases involving issues of drug and alcohol use and domestic violence, and represent those seeking injunctions, for example using non-molestation or occupation orders against your ex-partner or another person. I also represent people who are subject to applications for non-molestation orders or occupation orders in respect of the family home.

Public Law Children

I act in public law proceedings. In care proceedings, I have represented parents and extended family members in cases including fact-finding proceedings, involving serious non-accidental injuries, chronic neglect and sexual abuse. These circumstances may involve my representing you either where the Local Authority or other organisation with responsibility for the welfare of children wishes to remove the child from your care, or as already done so.

I am known for my objective and pragmatic approach, and have experience in dealing with vulnerable clients with mental health difficulties or learning disabilities.

Divorce and Matrimonial Finance

Financial remedies arising out of divorce are a central part of my practice, and I have represented parties in cases across the spectrum from those limited to need and modest wealth to multi-million pound cases involving complex asset structures.

My cases often involve business assets, investment properties, sizeable pensions and trusts as well as issues of post-separation earning, conduct, and inherited wealth. You may wish to seek advice before you begin any proceedings to ensure you are able to make informed decisions throughout, but equally if you have already begun matters and found yourself needing additional expert advice I would be happy to discuss your circumstances.

Civil Partnership & Cohabitation Dispute

I regularly represent co-habitants and co-owners in property disputes governed by the Trusts of Land and Appointment of Trustees Act 1996 (‘TOLATA’). These cases invariably concern issues of either an expressed or implied trust in terms of property ownership and interests, where issues have subsequently arisen (usually on the break-down of a relationship) around levels of financial or other contributions to the home or improvements made to it, and equitable accounting. I also have experience of cases involving a third party who, whether in relation to a loan or other circumstances, seeks to have an interest in a property recognised.

I can advise you and assist with drafting documents at any stage as well as representing you during proceedings.

Property and Land Law

I practise housing law and am regularly instructed by local authorities, private landlords and tenants in possession proceedings and related litigation.

I act in a wide range of residential and commercial disputes; including trusts, possession actions, lease renewal negotiations and service charge challenges; providing advice and representation at every stage of proceedings.
