Reducing a husband’s payments to a manageable level

Holly represented a client who was seeking to reduce the level of maintenance payments that he made to his former wife. He had agreed a generous provision some years earlier but was now struggling to afford them. His ex-wife’s circumstances had changed – including having moved away from the family home, so he applied for a staged reduction in payments, to reduce eventually to a nominal £1 a year. He also sought permission to not have to repay the arrears in maintenance that had built up due to his financial difficulties.

Holly assisted her client at both hearings, initially on a Direct Access basis and later through a solicitor. She prepared a detailed schedule and skeleton argument for the court. The judge heard evidence from both parties and arguments from their representatives.

The Court granted her client’s application, reducing his immediate payments to his former wife by over 40% and ordering that they reduce to £1 per year in a year’s time. He was also not ordered to repay the arrears that had accrued.
