Recovering possession of land and settling a claim for a beneficial interest by family-member tenant

Holly was instructed through the Direct Access scheme to assist a client who was seeking to recover possession of his property, in circumstances where there was no tenancy agreement and uncertainty as to whether he had complied with the requirement to protect a deposit. The tenant, a family member, counter-claimed for a life interest in the property and the matter was set down for trial.

The case involved Holly in advising on the procedure and prospects of success of the possession claim, drafting a witness statement and arranging for a solicitor to assist the client in giving proper disclosure and compiling the trial bundle.

The case was settled before trial with the client recovering possession of the property whilst assisting the tenant family member with future housing.
