Lifting a freezing injunction

Holly represented a husband, in proceedings in which the family funds were to be divided following divorce.

However, without recourse to his wife, Holly’s client had already sold the family home and distributed the sale proceeds amongst his family. The wife obtained a freezing injunction, which prevented him from using his bank accounts or dealing with his pensions other than the monthly income payments. He was ordered pay the remainder of the funds from the sale of the property into a court bank account.

Holly represented the husband at two dispute resolution appointments and was able to negotiate a final agreement between the parties. The funds held in court were released, the parties’ other property was transferred to the wife, and the husband retained all his pensions. The freezing injunction was lifted and Holly secured a clean break for her client.
